In the 20-year-old 6-storey building, more than 30% of the residents are 60 or 70-year-olds, hoping to install elevators to solve the problem of not being able to get out, but because the residents of 1 or 2 do not agree, the old building will add The plan to install an elevator cannot pass. Many old communities in Beijing have always had such trouble installing elevators in old buildings.

However, according to laws and regulations such as the Property Law, when an existing residence needs to use a common part to add an elevator, or the shape or structure of the common part needs to be changed due to the addition of an elevator, it shall be approved by the owner whose exclusive part occupies more than two-thirds of the total building area and Over two-thirds of the total number of owners agreed. In other words, the law does not require everyone to agree before installing elevators.

From now on, the installation of elevators in old buildings in Beijing will no longer implement the one-vote veto system. The "Manual for Comprehensive Renovation of Beijing’s Old Community" released today clarified for the first time that three conditions can be met before the installation of elevators can be carried out:

First, the owners who are willing to install elevators should have the right to occupy and use the house and be able to show relevant evidence;

Second, the residential buildings to be installed with elevators should meet the requirements of building structural safety, fire safety, and building energy efficiency.

Third, the intention and preliminary plan for installing elevators in existing multi-storey residential buildings should fully listen to the opinions of all owners within the scope of the proposed installation of elevators, and the exclusive part of the owners who account for more than two-thirds of the total construction area of the unit residential More than two-thirds of the total number of owners agree, and other owners have no objections.

The focus is on the third. In other words, when the two-thirds of the owners involved in the building agree and the other owners have no objections, the elevator can be installed. This is undoubtedly good news for many residents of old buildings.

The manual also proposes that the implementation entity should discuss the feasibility of the installation of the elevator construction plan, the cost-raising plan for the installation of the elevator, the operation and maintenance cost after the installation of the elevator is put into use, the confirmation of the main body of the elevator after the completion of the use and management, and the elevator operation and maintenance commission plan. Matters, reached an elevator installation agreement with the relevant owners involved in the installation of the elevator.
